This Site and the tools and applications accessible through this Site (the “Site) belong to and are maintained and operated by Alliance for Youth Action (the “Alliance”) an Oregon nonprofit corporation that is exempt from taxation as an advocacy and social welfare organization under section 501(c)(4) of the Internal Revenue Code.
By logging into and using the tools and applications on this Site, you (1) agree to be bound by these Terms of Use (2) agree to our Privacy Policy, which can be found here and (3) agree to be bound by other legal notices that may be posted on the Site from time to time. The legally binding terms of these documents set out your rights, obligations and restrictions regarding your use of the Site.
In order to participate in certain services you may be required to download content, software, and/or required to agree to additional terms and conditions. Unless otherwise expressly set forth in any such additional terms and conditions applicable to the specific services in which you choose to participate, those additional terms are hereby incorporated into these Terms of Use.. You are only authorized to use the Site if you agree to be bound by these Terms of Use and the Privacy Policy.
1. Voter Registration and Voting Information
The Alliance maintains a page on the Site that allows you either to register or vote online or to prepare a voter registration form to mail in to the appropriate election agency, with the Site providing instructions on how to do so. The Alliance uses a third-party site or sites to provide this Service.
If you register online or through mailing in a form, using the site, you are solely responsible for checking with the election agency to determine if your application was timely received and if you successfully registered to vote. The Alliance is not responsible for any defect or problem in your registration application, or for any delay or failure of any election agency to accept your registration or to register you to vote.
2. Exclusion of Warranties and Limitation of Liability
The Alliance makes no warranty or representation to you or any user of the Site, or any organization that you represent, as to the accuracy, integrity, and quality of any information, guidance, instruction or advice provided by the Alliance, any user or any Alliance Affiliate or Partner organization, in or through the Site. You agree that the Alliance has not legally warranted or represented that any particular results will be achieved by following such information and guidance, and that you must evaluate, and bear all risks associated with, the use of any such information and guidance.
You agree that the Alliance assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, user communications. the Alliance is not responsible for any problems or technical malfunction of any telephone network or lines, computer systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any Site or combination thereof, including injury or damage to users or to any other person’s computer related to or resulting from participating or downloading materials in connection with the Site.
Under no circumstances will the Alliance be responsible for any loss or damage, including but not limited to personal injury or death, resulting from anyone’s use of the Site, any user-created content posted on the Site or transmitted to users, or any interactions between users of the Site, whether online or offline.
Any services, tools, or applications offered through the Site (the “Services”) are provided “AS-IS” and (to the extent legally permitted) the Alliance expressly disclaims any warranty of fitness for a particular purpose or non-infringement, and further expressly disclaims any implied warranty and terms and conditions. the Alliance cannot guarantee and does not promise any specific results from use of the Site and/or the Services.
Except where restricted or prohibited, in no event will the Alliance be liable to you or any third person for any indirect, consequential, exemplary, incidental, special, or punitive damages, including lost profits arising from your use of the Site even if the Alliance has been advised of the possibility of such damages.
3. Events and Programs
Communities and individuals will be able to recruit users of the Site to participate in various actions, including voter registration days and programs, voter mobilization events and programs, trainings, advocacy events and actions and similar events. The Alliance may co-sponsor certain of these actions or events (each, an “Action”). You participate in any such Action solely at your own risk.
You agree hereby irrevocably and unconditionally to release, acquit, and forever discharge the Alliance and the Alliance for Youth Organizing and their respective directors, officers, employees and agents (the “the Alliance Releasees”), from any and all claims, liabilities, obligations, promises, agreements, controversies, demands, actions, causes of action, suits rights, damages, costs, losses, debts and expenses (including attorneys’ fees) of whatever kind or nature, in law or in equity, whether known or unknown, which you now have or may hereafter claim to have had against the Alliance Releasees, arising from your participation in any Action.
The Alliance does not plan, endorse or sponsor any Action that involved any civil disobedience or violation of any applicable law.
4. Law Governing
These Terms of Use will be governed by and construed in accordance with the laws of the District of Columbia without regard to the District’s conflict of law rules. Any action to enforce or arising under these Terms of Use will be brought only in the federal or state courts of the District of Columbia and you consent to the exercise of personal jurisdiction by such courts in any such action.
